Acestea se referea la o serie de ac\u021biuni pe care angajatorul este obligat prin lege s\u0103 le efectueze pentru a pastra s\u0103n\u0103tatea \u0219i capacitatea de munc\u0103 angajatorului.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Normele de protec\u021bie a muncii \u2013 prevederi legislative<\/h2>\n\n\n\n<p>Numeroase acte normatice alc\u0103tuiesc legisla\u021bia privind protec\u021bia lucr\u0103torilor, dintre care cele mai semnificative sunt:<\/p>\n\n\n\n<ul>\n<li><strong>Codul Muncii<\/strong>&nbsp;(Legea 53 din 2003, actualizat\u0103);<\/li>\n\n\n\n<li><strong>Legea 319 din 2006<\/strong>&nbsp;(cu modific\u0103rile aduse), privind securitatea \u0219i s\u0103n\u0103tatea \u00een munc\u0103;<\/li>\n\n\n\n<li><strong>Hot\u0103r\u00e2rea de Guvern 1.425 din 2006<\/strong>&nbsp;(cu modific\u0103rile aduse), pentru aprobarea Normelor metodologice de aplicare a prevederilor Legii 319\/2006;<\/li>\n\n\n\n<li><strong>Normele generale \u0219i specifice de protec\u021bie a muncii<\/strong>&nbsp;(cu modific\u0103rile aduse).<\/li>\n<\/ul>\n\n\n\n<p>Trebuie subliniat c\u0103 normele legislative se aplic\u0103 tuturor domeniilor de activitate, at\u00e2t publice, c\u00e2t \u0219i private. Acestea se aplic\u0103 \u0219i domeniilor asigur\u0103rilor sociale, egalit\u0103\u021bi intre femei \u0219i b\u0103rba\u021bi \u0219i fac referiri explicite la anumite grupuri de salaria\u021bi cu nevoi speciale.<\/p>\n\n\n\n<p>Inspectoratul Muncii, organiza\u021bie \u00eenfiin\u021bat\u0103 \u00een 1999, are o gam\u0103 larg\u0103 de acte normative referitoare la securitatea \u0219i s\u0103n\u0103tatea \u00een munc\u0103, care pot fi g\u0103site pe site-ul oficial.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Ce sunt normele de protec\u021bie a muncii?<\/h3>\n\n\n\n<p>Reglement\u0103rile privind s\u0103n\u0103tatea \u0219i securitatea \u00een munc\u0103 sau protec\u021bia muncii se refer\u0103 la orice ac\u021biuni inreprinse pentru a reduce probabilitatea ca lucr\u0103torii s\u0103 se \u00eemboln\u0103veasc\u0103 sau s\u0103 se r\u00e2neasc\u0103 \u00een timp ce sunt angaja\u021bi \u00een activitatea lor.<\/p>\n\n\n\n<p>Informarea, consultarea, instruirea \u0219i protec\u021bia angaja\u021bilor fac parte din acest sistem de reguli \u0219i activit\u0103\u021bi, care include, de asemenea, asigurarea aplic\u0103rii corecte a regulilor de stabilitate, \u00een conformitate cu legile aplicabile.<\/p>\n\n\n\n<p>Orice companie are responsabilitatea de a oferi un loc de munc\u0103 sigur pentru ace\u0219ti lucr\u0103tori. La r\u00e2ndul lor ace\u0219tia trebuie, de asemenea, s\u0103 respecte standardele stabilite. Orice \u00eenc\u0103lcare a legii se pedepse\u0219te \u00een conformitate cu termenii acesteia.<\/p>\n\n\n\n<p><strong>Conform Codului Muncii, normele care reglementeaz\u0103 s\u0103n\u0103tatea \u0219i securitatea la locul de munc\u0103 pot:<\/strong><\/p>\n\n\n\n<ul>\n<li>M\u0103suri de precau\u021bie de baz\u0103 de s\u0103n\u0103tate \u0219i siguran\u021b\u0103 care implementate pentru tot personalul;<\/li>\n\n\n\n<li>Reglement\u0103ri unice de siguran\u021b\u0103 pentru anumite ocupa\u021bii \u0219i activit\u0103\u021bi;<\/li>\n\n\n\n<li>Orient\u0103ri specifice pentru anumite tipuri de angaja\u021bi;<\/li>\n\n\n\n<li>Reguli care se refer\u0103 la modul \u00een care sunt \u00eenfiin\u021bate \u0219i gestionate entit\u0103\u021bile speciale pentru a asigura s\u0103n\u0103tatea \u0219i securitatea lucr\u0103torilor.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">De ce sunt importante normele de protec\u021bie a muncii<\/h3>\n\n\n\n<p>Bolile profesionale care s-au dezvoltat ca urmare a desf\u0103\u0219ur\u0103rii activit\u0103\u021bii \u00een condi\u021bii grele de munc\u0103, accidente de munc\u0103, incidente grave care au dus frecvent chiar la decesul angaja\u021bilor sunt c\u00e2teva dintre motivele care au stat la baza dezvolt\u0103rii normelor de munc\u0103.<\/p>\n\n\n\n<p>Legile privind protec\u021bia muncii trebuie respectate pentru a evita circumstan\u021be complexe \u0219i extrem de nepl\u0103cute at\u00e2t pentru angajator c\u00e2t \u0219i pentru angaja\u021bi.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Cum func\u021bioneaz\u0103<\/h4>\n\n\n\n<ul>\n<li>Ajut\u0103 la evaluarea pericolelor la locul de munc\u0103 \u0219i la evitarea acestora;<\/li>\n\n\n\n<li>Acestea presupun localizarea \u0219i abordarea factorilor care contribuie la apari\u021bia anumitor pericole la locul de munc\u0103;<\/li>\n\n\n\n<li>Ofer\u0103 medii de lucru adaptate cerin\u021belor oamenilor;<\/li>\n\n\n\n<li>Necesit\u0103 ca dumneavoastr\u0103 c\u00e2t \u0219i afacerea dumneavoastr\u0103 s\u0103 v\u0103 adapta\u021bi \u00een mod regulat la progresele tehnologice;<\/li>\n\n\n\n<li>Includ reevaluarea ideii de risc;<\/li>\n\n\n\n<li>Necesit\u0103 dezvoltarea unor strategii preventive am\u0103nun\u021bite \u0219i coerente, \u021bin\u00e2nd cont de nivelul de tehnologie, organizarea locului de munc\u0103, condi\u021biile de munc\u0103, interac\u021biunile sociale \u0219i impactul elementelor de mediu;<\/li>\n\n\n\n<li>Prev\u0103d indica\u021bii precise pentru personal, astfel \u00eenc\u00e2t s\u0103 nu existe ambiguitate \u00een aplicarea acestora;<\/li>\n\n\n\n<li>Protejeaz\u0103 grupuri de lucr\u0103tori care sunt mai vulnerabili la riscuri de boli \u0219i r\u0103niri dec\u00e2t restul for\u021bei de munca;<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">Sanc\u021biuni pentru nerespectarea normelor de protec\u021bie a muncii<\/h3>\n\n\n\n<p>Agen\u021biile responsabile pot aplica pedepse specifice \u00een cazul nerespect\u0103rii Codului Muncitorului \u0219i a altor legisla\u021bii referitoare la protec\u021bia muncii.<\/p>\n\n\n\n<p><strong>Infrac\u021biuni (potrivit Codului Penal):<\/strong><\/p>\n\n\n\n<p><strong>Amenda sau \u00eenchisoare de la 6 luni la 3 ani dac\u0103:<\/strong><\/p>\n\n\n\n<p>Lipsa m\u0103surilor preventive creeaz\u0103 un risc imediat de accident sau boal\u0103.<\/p>\n\n\n\n<p><strong>Amenda sau \u00eenchisoare de la 6 luni la 3 ani dac\u0103:<\/strong><\/p>\n\n\n\n<ul>\n<li>Legile muncii nu sunt respectate at\u00e2t de angajatori, c\u00e2t \u0219i de angaja\u021bi, cre\u00e2nd un risc serios;<\/li>\n\n\n\n<li>Se repun \u00een func\u021biune echipamente far\u0103 a remedia toate problemele care au determinat s\u0103 nu mai func\u021bioneze \u00een primul r\u00e2nd.<\/li>\n<\/ul>\n\n\n\n<p><strong>Amenda sau \u00eenchisoare de la 3 luni la un an dac\u0103:<\/strong><\/p>\n\n\n\n<p>Dac\u0103 faptele sunt s\u0103v\u00e2r\u0219ite din culp\u0103 \u00een cazurile descrise mai sus.<\/p>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Normele de protec\u021bie a muncii sunt menite s\u0103 garanateze c\u0103 lucr\u0103torii au cele mai bune condi\u021bii de munc\u0103 posibile.
