Obliga\u021biile generale ale angajatorilor sunt prev\u0103zute \u00een Legea 319\/2006.<\/p>\n\n\n\n<h4 class=\"wp-block-heading\">Cum poate angajatorul organiza activit\u0103\u021bi de prevenire \u0219i protec\u021bie?<\/h4>\n\n\n\n<ul>\n<li>Prin transferarea c\u0103tre angajator a atribu\u021biilor pentru efectuarea m\u0103surilor legale \u00een condi\u021biile art.9 alin. (4) din legisla\u021bie;<\/li>\n\n\n\n<li>Prin desemnarea uneai sau mai multor persoane care s\u0103 se ocupe de planurile de prevenire \u0219i protec\u021bie;<\/li>\n\n\n\n<li>Prin crearea unuia sau mai multor servicii interne de prevenire \u0219i securitate;<\/li>\n\n\n\n<li>Prin utilizarea serviciilor externe de protec\u021bie \u0219i prevenire la locul de munc\u0103.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Ce condi\u021bii trebuie \u00eendeplinite?<\/h4>\n\n\n\n<ul>\n<li><a href=\"https:\/\/aplicatiessm.ro\/blog\/?p=363&amp;preview=true\">Microprinderi \u0219i \u00eentreprinderi mici<\/a>: Microprinderile sunt definite c\u0103 av\u00e2nd mai pu\u021bin de 10 lucr\u0103tori \u0219i care au o cifra de afaceri anuala sau un bilan\u021b anual mai mic de 2 milioane EUR. \u00centreprinderile mici sunt definite c\u0103 av\u00e2nd mai mutin de 50 de angaja\u021bi \u0219i au o cifra de afaceri sau un bilan\u021b anual mai mic de 10 milioane de EUR;<\/li>\n\n\n\n<li>Este necesar s\u0103 desf\u0103\u0219oare activit\u0103\u021bi far\u0103 un pericol deosebit;<\/li>\n\n\n\n<li>Angajatorul trebuie s\u0103 posede expertiza necesara.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Daca toate cerin\u021bele urm\u0103toare sunt \u00eendeplinite, un angajator se poate angaja \u00een activit\u0103\u021bi legate de securitatea \u0219i s\u0103n\u0103tatea la locul de munc\u0103 \u00een organiza\u021bii cu p\u00e2n\u0103 la nou\u0103 angaja\u021bi:<\/h4>\n\n\n\n<ul>\n<li>Opera\u021biunile \u00eentreprinderii nu \u00eendeplinesc standardele prev\u0103zute \u00een anexa nr.5 din metodologia de aplicare a Legii 319\/2006;<\/li>\n\n\n\n<li>Angajatorul \u00ee\u0219i desf\u0103\u0219oar\u0103 eficient \u0219i consecvent activitatea profesional\u0103 \u00een afacere sau unitate;<\/li>\n\n\n\n<li>Angajatorul a finalizat cel pu\u021bin un program de formnare \u00een domeniul securit\u0103\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii la locul de munc\u0103, cu o durat\u0103 minim\u0103 de 40 de ore.<\/li>\n<\/ul>\n\n\n\n<h4 class=\"wp-block-heading\">Dac\u0103 toate cerin\u021bele urm\u0103toare sunt \u00eendeplinite, un angajator poate desf\u0103\u0219ur\u0103 activit\u0103\u021bi legate de securitate \u0219i s\u0103n\u0103tate la locul de munc\u0103 \u00een cazul \u00eentreprinderilor cu 10 \u0219i 49 de angaja\u021bi:<\/h4>\n\n\n\n<ul>\n<li>Opera\u021biunile \u00eentreprinderii nu \u00eendeplinesc standardele prev\u0103zute \u00een anexa nr.5 din orient\u0103rile metodologice de executare a Legii 319\/2006;<\/li>\n\n\n\n<li>Angajatorul \u00ee\u0219i desf\u0103\u0219oar\u0103 eficient \u0219i consecvent activitatea profesional\u0103 \u00een afacere sau unitate;<\/li>\n\n\n\n<li>Angajatorul a finalizat cel pu\u021bin un program de formare \u00een domeniul securit\u0103\u021bii \u0219i s\u0103n\u0103t\u0103\u021bii \u00een munc\u0103, cu o durat\u0103 minim\u0103 de 40 de ore;<\/li>\n\n\n\n<li>Pericolele care au fost identificate nu pot duce la accidente sau boli profesionale cu efecte grave, permanente, cum ar fi desecul sau invaliditatea.<\/li>\n<\/ul>\n\n\n\n<p>Angajatorul trebuie s\u0103 numeasc\u0103 unul sau mai mul\u021bi salaria\u021bi sau s\u0103 \u00eenfiin\u021beze unul sau mai multe servicii interne de prevenire \u0219i protec\u021bie care s\u0103 se ocupe de opera\u021biunile de prevenire \u0219i protec\u021bie din interiourul companiei \u00een cazul firmelor \u0219i\/sau unit\u0103\u021bilor cu intre 50 \u0219i 249 de lucr\u0103tori.<\/p>\n\n\n\n<p>Angajatorul trebuie s\u0103 \u00eenfiin\u021beze unul sau mai multe servicii interne de prevenire \u0219i protec\u021bie pentru \u00eentreprinderile \u0219i\/sau unit\u0103\u021bile de peste 250 de angaja\u021bi.<\/p>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity is-style-wide\"\/>\n\n\n\n<p>\u00cen concluzie, angajatorul \u00ee\u0219i asum\u0103 responsabilitatea pentru SSM la locul de munc\u0103 \u0219i trebuie s\u0103 se asigure c\u0103 acestea respect\u0103 reglement\u0103rile aplicabile. Aceasta include furnizarea de formare adecvat\u0103 \u00een domeniul s\u0103n\u0103t\u0103\u021bii \u0219i siguran\u021bei, stabilirea unor controale adecvate pentru a minimiza riscurile de r\u0103nire \u0219i asigurarea faptului c\u0103 lucr\u0103torii lor sunt con\u0219tien\u021bi de drepturile lor atunci c\u00e2nd vine vorba de SSM. \u00cen plus, angajatorul este responsabil pentru asigurarea unei protec\u021bii adecvate \u00eempotriva pericolelor pentru s\u0103n\u0103tate \u00eent\u00e2lnite la locul de munc\u0103.
